The Ukrainian Center for Independent Political Research (UCIPR) has prepared an analysis of Draft Law No. 15051, "On Amendments to Article 6 of the Law of Ukraine 'On Humanitarian Aid' Regarding Enhancing the Accessibility of Specialized Transport for Persons with Disabilities."
The document aims to eliminate restrictions that complicate the import of specialized vehicles as humanitarian aid for persons with disabilities. Current legislation stipulates that such vehicles must be no more than 8 years old and have an engine capacity of up to 1800 cc. However, in practice, a significant portion of such vehicles available on the EU market are used and exceed these established parameters.
The Draft Law proposes waiving age and engine capacity restrictions for special-purpose passenger cars imported as humanitarian aid for transfer to persons with disabilities or social protection foundations. For such vehicles, a separate engine capacity limit of up to 3000 cc is proposed. Thus, the document introduces a special legal regime for transport designed to meet the needs of persons with disabilities.
UCIPR experts note that the proposed changes could have a positive impact, particularly by removing regulatory barriers to the import of specialized transport, improving the mobility of persons with disabilities, and expanding humanitarian aid opportunities. Notably, the implementation of the Draft Law does not require additional expenditures from state or local budgets.
At the same time, the Draft Law simultaneously declares the abolition of restrictions while setting a new engine capacity limit, which could create legal uncertainty. Furthermore, the use of the term "special-purpose vehicles" does not align with industry legislation, which employs the term "specialized vehicles."
Additionally, the provisions of the Draft Law are not synchronized with current bylaws regarding the provision of cars to persons with disabilities, do not account for environmental standards for vehicles, and may create risks of misuse.
Overall, the Draft Law addresses a pressing social issue and has the potential to positively impact the rights of persons with disabilities. However, it is necessary to resolve internal contradictions regarding engine capacity limits, align terminology with existing legislation, and clearly define the categories of humanitarian aid recipients.
Therefore, it is advisable to support the Draft Law in its first reading, provided that necessary amendments are made for the second reading.
